5. Clients’ Responsibility for Their Users

HIPAA-related protections are available only to clients who (i) notify us in writing of their intent to use the platform to process Protected Health Information (PHI), and (ii) receive written confirmation from us that HIPAA features have been activated on their account and a Business Associate Agreement (BAA) has been executed. Absent such written confirmation and agreement, we disclaim all responsibility for handling PHI or other regulated data.

We do not process, access, or assume liability for any Protected Health Information (PHI) or other regulated sensitive data unless explicitly agreed to in a signed Business Associate Agreement (BAA). You must notify us in writing if you intend to use our Services to transmit or store PHI. Absent such an agreement, we disclaim all liability and obligations associated with the handling of PHI or regulated data.

6. Role as Data Processor

For clients using our Services to interact with their own users or customers, we act solely as a data processor. You, as the client, are the data controller and are solely responsible for obtaining all necessary consents and for the legal use of the data you collect. We do not determine the purposes or means of the processing of that data.

7. Communication Tools and Consent

By using our Services, you grant us permission to send and receive SMS, place and record phone calls, and deliver emails on your behalf as part of your account’s functionality. You are solely responsible for obtaining all legally required consents from your users, contacts, or customers before initiating communication using our platform. You understand and agree that use of our Services is at your own risk, and we do not guarantee absolute security.
